Voting rights in a pandemic: Supreme Court reimposes witness requirement, creating a significant barrier for voters and risking public safety

This list isn't comprehensive. I focused on the most recent court rulings rather than the most important of the year. Since keep_track is more focused on the Trump administration's actions than on state laws, I'd suggest also checking out /savethevote, where I try to post voting rights articles that don't fit here.
Before we start, one of the key legal issues at hand is called the "Purcell principle," a legal doctrine based on a 2006 Supreme Court case, Purcell v. Gonzalez, that warns courts against making changes to voting rules and procedures close to an election. But with so many more voters casting their ballots early this year because of the pandemic, courts are grappling with how to balance the Purcell principle with making sure the right to vote is protected.

Losses for voting rights

South Carolina: The Supreme Court on Monday reinstated the witness requirement for South Carolina mail ballots after lower courts ruled that having the requirement created risk during the pandemic. As usual for a shadow docket case, it didn’t explain its decision.
  • Ballots received within two days of the order will be accepted without a witness signature. Three conservative justices - Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch - would have allowed South Carolina to apply the witness signature rule retroactively, nullifying tens of thousands of ballots already cast. Furthermore, South Carolina has no ballot “cure” procedure: Voters aren’t notified when their ballots are tossed, and they don’t get an opportunity to fix any defects.
Wisconsin: A three-judge panel of the 7th Circuit Court of Appeals split 2-1 in favor of staying a lower court’s order, which would have allowed for ballots postmarked by Election Day to be received by Nov. 9, six days later, in order to be counted. The stay also suspended an order extending the deadline for online and mailed-in voter registration from Oct. 14 to Oct. 21, and it stopped potential electronic delivery of certain ballots.
  • Judge Frank Easterbrook (Reagan appointee) and Amy St. Eve (Trump appointee) were in the majority. Judge Ilana Rovner (George H. W. Bush appointee) dissented, writing that “no citizen should have to choose between her health and her right to vote.”
Texas The Texas Supreme Court ruled Wednesday that Harris County, one of the largest in the country, cannot mail out applications for absentee ballots to all of its 2.4 million registered voters. The court is completely staffed with Republican appointees. The state sued County Clerk Chris Hollins in August. Both the state district judge and panel of three state appellate judges (all Democrats) ruled in favor of Hollins.
Georgia: A three-judge panel of the 11th U.S. Circuit Court of Appeals decided 2-1 to grant a stay of a judge’s ruling to count ballots postmarked by Nov. 3 and received at county election offices by the following Friday. Under the new order, ballots must be received by 7pm on Election Day, no matter the postmark.
  • Trump Trump appointees were in the majority: Judge Britt Grant and Barbara Lagoa. Judge Charles Wilson (Clinton appointee) dissented, writing that the lower court’s order allowing ballots to be received for a couple extra days was “reasonable: It imposes a small burden on the state in order to avoid a more substantial burden on an individual’s right to vote.”
Indiana: A three-judge panel of the 7th Circuit Court of Appeals upheld a lower court ruling that the state’s restrictions on allowing mail-in voting are constitutional. A coalition of voting rights groups and concerned voters has sued to extend the no-excuse mail-in balloting that Indiana allowed for the spring primary to the general election.
“The court recognizes the difficulties that might accompany in-person voting during this time,” the ruling said. “But Indiana’s absentee-voting laws are not to blame. It’s the pandemic, not the State, that might affect Plaintiffs’ determination to cast a ballot.”
  • A Trump appointee, Michael Scudder, and two Reagan appointees - Kenneth Ripple and Michael Kanne - were unanimous in their ruling.

Wins for voting rights

Pennsylvania: Judge Gary Glazer (Pennsylvania Court of Common Pleas) rejected a bid by Trump’s campaign to force Philadelphia to allow campaign representatives to monitor people registering to vote or filling out mail-in ballots in election offices in Philadelphia. Trump sent unautohrized poll watchers to the city’s satellite election offices but they were barred by city election officials.
  • Trump and his supporters spread false claims that the city workers are biased against Trump and trying to steal the election.
EDIT: Pennsylvania: New this morning, Trump-appointed District Court Judge Nicholas Ranjan has dismissed a Trump campaign lawsuit challenging drop boxes for mail voting in Pennsylvania. Ranjan says Trump presented no credible evidence of voter fraud. Ruling.
Ohio: U.S. District Judge Dan Polster (Clinton appointee) blocked Ohio Secretary of State Frank LaRose's order prohibiting off-site drop boxes for absentee ballots. LaRose tried to limit ballot drop boxes to one location per county: a county's election office. A three-judge panel of the 10th Circuit had previously ruled that county elections officials are allowed to establish off-site drop boxes but LaRose did not comply.
"The Secretary is continuing to restrict boards from implementing off-site collection, and he appears to be doing so in an arbitrary manner," Polster wrote. "The Court has given the Secretary every opportunity to address the problem ... and he has been unwilling or unable to do so."
Montana: Supreme Court Justice Elena Kagan on Thursday denied a request from Republicans to block Montana Gov. Steve Bullock's directive last month allowing counties to send mail-in ballots to all registered voters amidst the coronavirus pandemic. Kagan, who has jurisdiction over the lower court involved in the case, turned down the request without referring the petition to her colleagues or asking the other side for its views.
Michigan: Michigan Governor Gretchen Whitmer signed into law a bill that gives clerks in larger cities of the battleground state an extra 10 hours to open and sort, but not count, absentee ballots in a move to speed the Election Day counting process on Nov. 3.
Iowa: State Judge Robert Hanson (elected) blocked Iowa’s secretary of state Monday from enforcing an order that barred counties from sending absentee ballot applications to voters with their personal information already filled in. Republican groups, including the RNC and Trump’s campaign, have appealed the decision to the Iowa Supreme Court.
Arizona: U.S. District Judge Steven Logan (Obama appointee) on Monday granted a last-minute extension of the deadline for Arizona residents to register to vote - moving the deadline to 5 p.m. on Oct. 23.
Texas: The Texas Supreme Court declined a case by the Republican Party of Texas to reverse a proclamation by Gov. Greg Abbott that extended the early voting period. Gov. Abbott issued the proclamation in July to extend the early voting period six days from Oct. 13-30 due to COVID-19.
Texas: U.S. District Judge Robert Pitman (Obama appointee) granted an injunction barring enforcement of Gov. Greg Abbott’s Oct. 1 proclamation that limited counties to one mail-in ballot drop-off location. Texas Attorney General Ken Paxton, whose office defended Abbott’s order, has already appealed the decision to the 5th Circuit.
EDIT: A three-judge panel of the 5th Circuit has temporarily blocked Pitman's ruling from taking effect, thus meaning that Abbott's order is still in place. All three judges were appointed by Trump: Willet, Ho, and Duncan.
New Jersey: District Judge Michael Shipp (Obama appointee) ruled against the Trump campaign’s attempt to stop the state from allowing election officials to process ballots received by mail 10 days before Election Day and those received two days after Election Day even if those ballots don't have a postmark.

Keep an eye on…

USPS: The U.S. Postal Service is blocking members of Congress from inspecting postal facilities, citing the Hatch Act and the proximity to the election. Three Democrats — Reps. Jared Huffman (Calif.), Debbie Wasserman Schultz (Fla.) and Bill Pascrell Jr. (N.J.) — have been denied access to postal buildings in their home states in the past six weeks.
USPS: Sen. Peters released an update on USPS performance. The report shows that while on-time mail delivery improved following Congressional oversight efforts at the end of the summer, delivery performance has fluctuated in recent weeks, and declined overall during the month of September.
Intimidation: A private security company is recruiting former U.S. military Special Operations personnel to guard polling sites in Minnesota on Election Day, an effort the chairman of the company said is intended to prevent left-wing activists from disrupting the election but that the state attorney general warned would amount to voter intimidation and violate the law.
  • If you or someone else is being harassed or threatened at the polls, let a poll worker know. Then call and report it to the Election Protection Hotline (1-866-OUR-VOTE) or the US Department of Justice voting rights hotline (1-800-253-3931). You should also contact your state board of elections.
  • Georgetown Law created fact sheets for all 50 states explaining the laws barring unauthorized private militia groups and what to do if groups of armed individuals are near a polling place or voter registration drive.
  • Here are the laws regarding poll watchers in general in each state.
Volunteer! Information on volunteering at the polls (not as a watcher, but as an election worker). Another option for info.
Justice Department: A Justice Department lawyer in Washington said in a memo to prosecutors on Friday that they could investigate suspicions of election fraud before votes are tabulated. That reversed a decades-long policy that largely forbade aggressively conducting such inquiries during campaigns to keep their existence from becoming public and possibly “chilling legitimate voting and campaign activities” or “interjecting the investigation itself as an issue” for voters.
  • The exception allows investigators to take overt investigative steps, like questioning witnesses, that were previously off limits in such inquiries until after election results were certified. The move also allows prosecutors to make more of a spectacle of election fraud in the weeks before the vote on Nov. 3.
Kansas: Kansas Senate President Susan Wagle told a conservative group that Republicans need to win two-thirds majorities in both houses of the Kansas Legislature this year so her party can rig the redistricting process to elect and protect Republican candidates.
“During redistricting, I need to give (my potential successor) some more Republican neighborhoods in order to make sure she stays elected,” Wagle said. “I guarantee you, we can draw four Republican congressional maps,” Wagle said. “But we can’t do it unless we have a two-thirds majority in the (state) Senate and the House.”

As always though, polls don't vote, people do. Regardless of whether your candidate is doing well or poorly, democracy only works when people vote, and there are always at least a couple polling misses every cycle, some of which are pretty high profile. Prognosticators

Prognosticators are folks who make projected electoral maps, often on the strength of educated guesses as well as inside information in some cases from campaigns sharing internals with the teams involved. Below are a few of these prognosticators and their assessment of the state of the race:

Polling Models

Polling models are similar to prognosticators (and often the model authors will act like pundits as well), but tend to be about making "educated guesses" on the state of the election. Generally, the models are structured to take in data such as polls and electoral fundamentals, and make a guess based on research on prior elections as to the state of the race in each state. Below are a few of the more prominent models that are online or expected to be online soon:

Prediction Markets

Prediction markets are betting markets where people put money on the line to estimate the likelihood of one party winning a seat or state. Most of these markets will also tend to move depending on polling and other socioeconomic factors in the same way that prognosticators and models will work. Predictit and Election Betting Odds are prominent in this space, although RealClearPolitics has an aggregate of other betting sites as well.

My experience getting a card and first buy. ( Plus a NuggMD and Herbology review)

I just made my first purchase, and I figured going through my experience and the issues I ran into might be helpful to other new people. A couple of notes: my experience with marijuana is almost 0. Before I started looking at getting a card, I knew nothing about or program aside from it existing. So this is all from the perspective of a complete newbie.
Getting Medical Marijuana Without a Diagnosis When I first decided to get a card, I was unaware that a running injury got classified as chronic pain by the doctor, which meant I was looking for a card without a separate diagnosis. There was A LOT of misinformation out there (likely due to the law being confusing and the rules changing due to covid). You CAN get a card without a documented condition. If you go to a random mm doctor, it seems to be hit or miss based on anecdotes from people I talked to. This site however does offer ptsd diagnosis directly. I have not used them, but I was able to confirm they do have the ability to diagnose that issue online.
Experience With NuggMD (This is a bit ranty, so feel free to skip)
I opted for NuggMD since I found I had a previous diagnosis and heard good things. To be blunt, I do not reccomend them at all. They claim to be available during certain hours but the doctor was just not online usually. It took 3 days of scheduling appointments to actually get the doctor to show up. They will accept an appointment and then when it comes time there will just be no one online. It made for a frustrating experience.
The doctor I spoke with was not great either. He was uncomfortable to talk to and I never got a chance to ask questions. I heard a lot of people say the doctor they talked to went over some information and cleared a lot up. All I knew after my appointment was cbd is better for inflammation than thc (which was a weird note to make as it was not relevant to the diagnosis I provided).
After the appointment, my approval paperwork was literally a copy of 1 page of my medical records. It was as if they uploaded the wrong form. The following day, I got am email saying they would pay for a Google review. They never said it had to be positive, but I still found it to be a tad dishonest. It didn't help that they sent the request before I was ever officially approved (their site said I was, but I had yet to see any documentation to back that up and they had yet to send anything to the state). I complained at this point. Within 30 minutes of me complaining I got the email from the state and a reply saying that since i had just uploaded my medical history that day, they were finally able to send the approval. This was a complete lie as I uploaded it 4 or 5 days earlier and the doctor commented on it during the appointment.
With all of that said, I get get the card and it worked out in the end. It was a frustrating experience however, and I regret going with them.
Herbology Some good news now! I went with them after seeing great reviews from them and horrible reviews about a place closer to me (I did not use them obviously, so I won't name them). Herbology was phenomenal. I did place a fairly diverse order online and went in with my "expired but not expired" license, my card on my phone, and a bunch of other paperwork that I ended up not needing.
The staff was incredibly helpful, efficient, and friendly. Every person I interacted with was like that. They even printed and laminated my card, which was great.
I really don't have anything bad to say as the experience was completely painless. My schedule ended up being for a time that Google said it was significantly busier than normal and it still went pretty quick. Most of the time was spent them registering me. People that did not need that seemed to get in to make their purchase within 5 to 10 minutes. If I had to make 1 complaint, it would be that the building could be a bit more well lit.
Random Stuff/Questions I had Your prescription will have 3 refills on it. This basically just means you have 4 90 day periods (your initial 90 days plus 3 90 day periods after that). Honestly, you can just ignore it.
https://www.ohiomarijuanacard.com/buying-medical-marijuana-in-ohio this was the best resource I found for how much you can buy. It lists what 1 day is as well as what a 90 day supply is. Reminder that you'll need to divide the 90 day supply totals in half to find what you can buy during a specific 45 day window.
You CAN use an ID that expired during the states extension period. As a reminder, if your ID expired after March 9th 2020, it has been automatically extended to July 1st 2021. This was another area I ran into a lot of conflicting information. Those ID's ARE valid and you can find the documentation to back this up here. Someone here said they called the pharmacy board and got confirmation from them that a dispensary is required to accept these ID's if they are otherwise valid.
I think that covers everything. Hopefully someone comes across this and it helps them, I tried to answer the questions I had. The system is unnecessarily complex, but if you can work through it, its not a huge issue. I'm not going to post photos or reviews of what I got as I have very little experience or knowledge of weed and would not feel comfortable doing so.

My first and only vaporizer is the Pax 3 and I am probably buying a Fury Edge. Solid choice?

So for the last couple days I've been lurking through comments and chatting with a few people here and there, reading reviews, etc. I bought the Pax 3 practically on impulse when my life situation changed and I was suddenly able to get a card and get medicated in my state. I did very little research on the Pax 3 and I'm just not that happy with it.
I need two things: small dose capability, decent portability and speed of heating during the day, and small sessions in the evening. Pax 3 does the first two fairly well but I have a hard time imagining satisfying evening sessions with the Pax 3. By the end of a half packed oven it just tastes terrible.
I know I'm a noob but I'm going to try to regurgitate all the info I've looked at. Even if I'm not experienced I think I can consolidate some info in a decent way. First, some more Pax 3 info since that's what I'm actually using.
Problems with the Pax 3:

As I said, I have read a bunch of threads and comments here in vaporents and in OhioMarijuana and went through a bunch of their websites. Here are the devices I've considered based on what I found online:
Mighty/Crafty+:
It is still very tempting to get this device but they don't seem perfect for my uses. The longer warm ups and slightly larger oven size seem like they would be great for my evening sessions but not great throughout the day. It's still very tempting to go with Crafty+ over the Fury Edge. The temporary nail in the coffin for the Mighty is that there's rumors that the Mighty+ is coming soon. I'm the type of person that would be driven a little crazy by buying something like this right before a major refresh.
POTV One:
My understanding is that Planet of the Vapes One is a clone of the Fury 2. From what I have read, function is going to be very similar to the Fury Edge but the Fury Edge has some improvements (USB C quick charging, haptic feedback, etc.) and it's not much more money. If the POTV One was slightly cheaper, I might try it before the Fury Edge.
Firefly 2+:
There are a lot of mixed reviews on this guy. On one hand, if you use it correctly (apparently), this thing is basically perfect for microdosing; very fast heat up in a small bowl that cools very quickly to stop the "baking" after a hit. A textbook on demand device. On the other hand, lots of commenters and a few reviews talk about reliability and support issues and the device is $250. With a better reputation for support and a longer warranty, I might risk the troubles and pay the premium for what sounds like a great microdosing and small session device. In all honesty if not for the bad reputation this device would probably be my first pick.
ArGo:
This device still tempts me. The swappable tubes seem like a great preload solution because you are swapping the vapor path too. That, including the pre load stem kit, seems like it would be great for cleaning and flavor. You also have a swappable battery, looks to be a common 18650, so this thing is all about swap outs to keep it going. There are some fans of this device out there for sure but it seems like there are a lot more fans of the Fury series and POTV One. I think for the money the Fury Edge has a better form factor and following than the ArGo, but the ArGo is still a tempting choice.
Solo II:
This vape has a pretty good following and it sounds like it makes some great vapor but it looks like it's geared toward stronger, bigger sessions than I'm aiming for. Also, the form factor on this one seems less portable than the Fury Edge and if I was going to try an Arizer product, it would probably be the ArGo.
TinyMight:
The TinyMight looks amazing and I think I would buy it if it was in the US and/or cheaper. This vape seems to have a strong following and it sounds like it probably produces some of the best vapor possible in a portable. However, it's expensive and I read some stories about really slow shipping and back orders. I don't want to wait and rely on a device I could have to wait a very long time for repairs if something goes wrong. I think I want to buy one of these eventually if I have a better daily drivebackup to get by while waiting on the preorder at least. This might be my next purchase if I start collecting vapes.
Dynavap M:
This looks amazing but the trouble is that if I fire up a little torch to heat this thing my wife would have me in the dog house. The induction heating looks great but at that point it seems more cumbersome than most vaporizers. At the end of the day, I can see the allure of the Dynavap and I'm sure I would enjoy it in the right setting but it just doesn't fit my situation right now.
Launch Box:
The classic Magic Flight offering looks cool in a way but it kind of falls in a similar space as the Dynavap M. I do not think my wife would like the blatantly hippy styling of the device. I also thought the operation seemed kind of hokey, pressing in a battery to burn I think? High school me would have loved the style of this guy though.
VLeaf GO:
This device, in theory, is a perfect microdoser but it has an extremely short vapor path. You are basically inhaling straight over the flower. This seems geared for discreet microdosing and not flavor but that's the only thing a Pax 3 might be good for (with the cool down draws) and I already have a Pax 3.
Stempod OG 2.0:
The StemPod is very cool but its huge kit and it would also land me in the dog house if I busted it out. This looks like the ultimate tinker route though and I can see where this would make a very satisfying hobby piece, customizing performance and whatnot. Still, I really don't think this is what I need.
There are a few others that have some followings here (StickyBrick, Milaana 3, and others I can't think of) but I think this list mostly covers all the *big hitters* on vaporents.
Last but not least,
Fury Edge/Fury 2:
Again, the Fury 2 and POTV One came up a lot in the discussion threads about vaporizers. The design of this device, in my opinion, looks superior to the Pax in almost every way. You have device that is almost as small as the Pax but you have interchangeable mouth pieces, an OLED screen for temperatures, convenient looking dosing capsules, and it includes a little boot that goes over the standard mouthpiece and oven. From what people are saying, the smell is far less than the Pax 3 and the Fury devices are totally pocketable with just the included rubber boot.
It also sounds like the Fury 2, Fury Edge, and POTV One are all candidates for the glass bead mod too. This might be a way to get smoother vapor with the factory mouthpiece which will fit in the cover to maintain portability.
So, what is everyone's opinion on the choice of the Fury Edge? At the end of the day, I would like to have similar convenience to the Pax 3 with better vapor that's smoother and more flavorful. Do you think I will get that with the Fury Edge at least in comparison to the Pax?
